Habitual Traffic Offender (HTO) Violations
A person is designated a Habitual Traffic Offender if they either obtain three or more qualifying convictions within a five year period or receive fifteen civil traffic convictions within a five year period.
Qualifying Convictions
- Voluntary or involuntary manslaughter resulting from the operation of a motor vehicle;
- Driving Under the Influence;
- Any felony where a motor vehicle is used;
- Driving while License Suspended or Revoked;
- Leaving the Scene of a Crash that resulted in Death or Personal Injury; or
- Driving a Commercial Motor Vehicle with a Disqualified License.
If a person is designated a Habitual Traffic Offender, their license will be revoked for a period of five years and they will be unable to obtain a hardship license during the first year of their revocation period.
If they are caught driving for any reason during the first year of the revocation period, not only will they be ineligible to obtain a hardship license after the first year, they will have to wait out the full five year revocation to get a license, and they will be subject to criminal sanctions.
